Redstone Hill Design Competition: Terms and Conditions

  1. In these terms and conditions and all advertising material relating to the “Redstone Hill Design Competition” (Competition), Villawood means Villawood Management Pty Ltd (ABN 16 100 813 161).
  2. Information on how to enter and prizes form part of these terms and conditions.
  3. By participating in the Competition, entrants acknowledge that they have read and understood these terms and conditions and agree to be bound by them. Entries must be submitted in accordance with these terms and conditions to be valid.
  4. The Competition is a game of skill, and chance plays no part in determining the winners.
  5. The Competition commences on Friday, 3 March 2023 at 9:00 am AEDST and entries close on Monday, 26 June 2023 at 9:00am AEST.
  6. To be eligible for entry, entrants must:
    • be a resident of Australia;
    • be aged 18 years or older; and
    • be a student currently enrolled in a course of study at Deakin University, Federation University Australia, La Trobe University, Monash University, The University of Melbourne, RMIT University, Swinburne University of Technology or Victoria University, and currently studying in that course under the Architecture and/or Urban Planning and Design disciplines.
  7. Employees, managers and directors of Villawood and its related companies and suppliers and agencies involved in the Competition are not eligible to enter the Competition, nor are their immediate family members.
  8. To enter the Competition, entrants must register for the Competition and complete and submit a design response (Design) in a two part submission process as follows:
    • Registration: Entrants must register for the Competition by visiting https://villawoodproperties.com.au/community/redstone/redstone-design-comp/ and completing and submitting all mandatory fields of the registration form, any time before submitting Submission 1. Entrants can register for the Competition individually, or together with one or more other entrants as a group (Group), provided each member of a Group is eligible to enter the Competition and separately registers for the Competition in accordance with this clause.
    • Submission 1: Entrants (or Groups) must complete and submit Submission 1 of the Design by 9:00am on Monday, 1 May 2023 in accordance with the instructions at https://villawoodproperties.com.au/community/redstone/hill-info-portal/. Submission 1 must include a three part response as outlined under ‘Submission Requirements’ at https://villawoodproperties.com.au/community/redstone/hill-info-portal/. The purpose of Submission 1 is to track progress and feedback may be given directly to participants.
    • Submission 2: Entrants (or Groups) must complete and submit Submission 2 of the Design by 9:00am on Monday, 26 June 2023 in accordance with the instructions at https://villawoodproperties.com.au/community/redstone/hill-info-portal/. Submission 2 must include a pdf presentation responding to the eight site requirements listed at https://villawoodproperties.com.au/community/redstone/hill-info-portal/. A detailed site plan and any other plans that communicates the vision for the site in a succinct manner and artist impressions/3D renders of the design are required.
    • In order to be selected as a finalist, artist impressions must be supplied as part of Submission 2 in detailed, high quality, 300dpi. Students who do not have capabilities to provide an artist impression must notify Villawood when submitting Submission 1. Assistance to develop artist impressions may be made available, but only to exceptional design responses at Villawood’s discretion.
  9. Only one entry (whether an individual entry or a Group entry) is permitted per entrant.
  10. If an entrant’s (or Group’s) contact details change, it is the entrant’s (or Group’s) responsibility to notify Villawood in writing.
  11. All entries become the property of Villawood.
  12. Villawood will review all entries and a shortlist of Designs will be selected as finalists based on creativity, originality and accuracy to the site requirements. The finalists will be contacted using the contact details nominated in their registration form (unless an entrant (or Group) has notified Villawood of a change to their contact details in accordance with clause 10) by 14 July 2023 and invited to present their Design to a panel of judges selected by Villawood during the period of 24 July 2023 to 28 July 2023.  Villawood will use all reasonable endeavours to contact all finalists but accepts no responsibility if an entrant (or Group) cannot be contacted or is not available to present their Design.
  13. Three winners will be selected by the panel of judges. The winners will be the entrants (or Groups) which have the best, second-best and third-best Designs as determined by the panel of judges based on creativity, originality and accuracy to the site requirements.
  14. The winners will be notified by email and telephone using the contact details nominated in their registration form (unless an entrant (or Group) has notified Villawood of a change to their contact details in accordance with clause 10) by 18 August 2022.
  15. Villawood may publish the names of the winners on villawoodproperties.com.au and Villawood and Redstone social media accounts including LinkedIn, Instagram, Facebook.
  16. The winners will receive:
    • first prize (best Design): $20,000
    • second prize (second-best Design): $10,000
    • third prize (third-best Design): $5,000

Where a winning Design was entered by a Group, the prize will be awarded to the members of the Group jointly.  All prizes will be deposited to an Australian bank account nominated by the winning entrant (or Group).

  1. If an entrant (or Group) selected as a winner cannot be contacted, or is unable to accept any element of the prize or is disqualified from eligibility as the winner of the prize pursuant to these terms and conditions, then that entrant (or Group) will forfeit the prize in its entirety and the entrant (or Group) with the next best Design (as determined by the judging panel) will be selected as a winner. Villawood will not be liable to any entrant (or Group) selected as a winner who cannot be contacted or is disqualified from eligibility and therefore forfeits their prize and no correspondence will be entered into.
  2. Nothing in these terms and conditions limits, excludes or modifies any rights under the Australian Consumer Law or other applicable law. Except for any liability that cannot by law be excluded (in which case that liability is limited to the maximum extent allowable by law), Villawood (including its officers, employees and agents) excludes all liability for any death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person’s negligence) arising in any way out of or in connection with the Competition or these terms and conditions, the awarding or provision of any prizes, use of any of the prizes or the marketing of the Competition.
  3. Villawood reserves the right to disqualify any entries in its absolute discretion. For example, Villawood may disqualify: (a) any entrants (or Groups) or entries that tamper with, or attempt to tamper with the entry process; (b) incomplete, indecipherable or illegible entries or entries containing  false information or incorrect contact details; (c) any entries that contain material that is obscene, indecent, objectionable, defamatory, libellous or otherwise contravenes an applicable law or infringes any person’s rights; and (d) any entries that Villawood considers inappropriate for any reason.
  4. Villawood reserves the right, at any time, to verify the validity of entries and the details provided by entrants and to disqualify any entrant (or Group) who submits an entry that is not in accordance with these terms and conditions. The identification necessary for verification is at the sole discretion of Villawood. Errors and omissions may be accepted at Villawood’s discretion. Failure by Villawood to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. Each entrant grants Villawood a non-exclusive, royalty free, perpetual, irrevocable and sub-licensable right and licence to:
    • use, reproduce, copy, publish, display and communicate to the public their Design (in whole or part) for the purposes of conducting and promoting the Competition; and
    • use, reproduce, copy, modify, adapt and create derivative works from their Design (in whole or part), and publish, display and communicate to the public their Design (in whole or part) in any media and by any means, for any purpose of any of Villawood and its related companies from time to time (including the design, development or promotion of any land or developments by or on behalf of any of Villawood and its related companies).
  6. Each entrant warrants that:
    • they are legally entitled to submit their entry and they have obtained all necessary licences, consents and approvals in relation to their entry (including in relation to the use of the image or likeness of any person who appears in any still or moving images included in their entry) to enable the entrant to enter the entry in the competition and to permit Villawood to deal with their Design in accordance with the licence in clause 21;
    • they are (or, if they are a member of a Group, one or more members of the Group is) the owner of all copyright subsisting in their Design or they have all necessary rights to grant Villawood the licence in clause 21;
    • their Design is their own original work (or, if they are a member of a Group, the original work of one or more members of the Group), except where due and lawful acknowledgement and attribution is given; and
    • nothing in their Design nor any dealing with their Design in accordance with the licence in clause 21 will infringe the rights (including intellectual property rights or moral rights) of any person.
  7. Each entrant consents to Villawood (and any person authorised by Villawood) doing anything which, but for that consent, would infringe the entrant’s moral rights (as that term is defined in the Copyright Act 1968 (Cth)) in any works included in their Design, including:
    • failing to attribute the entrant as author of any works; and
    • making any change whatsoever to any works, including adding to or removing elements, combining them with any other material, and adapting them in any manner whatsoever.
  8. All entrants who are selected as winners consent to Villawood using their name, image, likeness, character, voice or anything else that identifies them without remuneration in any media worldwide (including in national print media, on Villawood’s website and in other promotional material) for a reasonable time to promote the Competition (including any outcome).
  9. Villawood is not responsible for any problems or technical malfunction of any communication network or for any late, lost, corrupted or misdirected entries or other communications whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. All entries are deemed to be received at the time of receipt in Villawood’s competition database. Entrants acknowledge that the Internet is not a secure medium and that Villawood is not responsible for the security of on-line entries.
  10. If for any reason the Competition is not capable of running as planned, including due to a computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Villawood which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of the Competition, Villawood reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition, subject to any applicable legislation.
  11. Privacy Statement. Villawood collects entrants’ personal information, and may disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and related companies, in order to conduct, administer and publicise the Competition.  By entering the Competition, entrants consent to Villawood using their personal information and sending them information in accordance with Villawood’s privacy policy (available at https://villawoodproperties.com.au/privacy-policy/) and otherwise agree to the terms of Villawood’s Privacy Policy.  Without limitation, Villawood and its related companies may, for an indefinite period unless and until otherwise advised by the entrant, use entrants’ personal information for marketing, advertising and opinion research purposes, including sending electronic messages or telephoning the entrant. This includes sending entrants information about Villawood properties or news.  Entrants can advise Villawood at any time if they no longer wish to receive marketing communications from Villawood, by contacting Villawood at the address below or in accordance with Villawood’s privacy policy.  If an entrant does not provide the information requested, they may not be able to enter the Competition.  Villawood’s privacy policy contains information about how entrants can contact Villawood to gain access to or seek correction of their personal information or make a privacy complaint.
  12. Each entrant (including all members of a Group) must comply with these terms and conditions. Each entrant indemnifies and will keep indemnified Villawood in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by Villawood as a direct or indirect result of the entrant acting inconsistently with or breaching any part of these terms and conditions.
  13. Villawood’s decision on all aspects relating to the Competition is final and no correspondence will be entered into.
